MarkIt (“MarkIt,” “we,” “us,” or “our”) values the privacy of its users. This Privacy Policy (“Policy”) describes how we collect, use, disclose, and protect personal information when you visit our website (www.markit-usa.com) or use the MarkIt mobile application and customer portal (collectively, the “Service”).
We reserve the right to update this Policy at any time. We will notify registered users by email and post the revised Policy with an updated “Last updated” date. Your continued use of the Service after such notice constitutes acceptance of the revised Policy.
This Policy applies only to information collected by MarkIt through the Service. It does not apply to third-party websites or services that may be linked from the Service.
Specifically, this Policy will inform you of the following:
- What personal information we collect and why;
- How we use and share your information;
- How long we retain your information;
- Your rights and choices regarding your information; and
- The security measures we take to protect your information.
Information We Collect
Account and registration information. When you create an account, we collect your name, email address, password (stored in hashed form), company name, and billing details.
Payment information. Payments are processed by Stripe, Inc. MarkIt does not store full credit card numbers. Stripe provides us with limited card metadata (last four digits, expiration date, card type) for account management purposes. Stripe’s use of your payment data is governed by the Stripe Privacy Policy.
User-provided CRM data. The Service allows you to import and manage contact records, customer information, sales activity logs, and related business data (“CRM Data”). CRM Data you upload belongs to you. We process it only to provide the Service.
Location data. The MarkIt mobile app may request access to your device’s location to support field-sales features such as door-knocking territory mapping. Location access is optional and controlled by your device’s permissions settings. We do not sell or share precise location data with third parties.
Usage and device data. We automatically collect information about how you use the Service, including IP address, browser type, operating system, pages visited, time spent, and referring URLs. This helps us improve the Service and troubleshoot issues.
Communications. If you contact us for support, we collect the content of your messages and your contact details to respond and improve our service.
Cookies and Tracking Technologies
We use cookies and similar technologies (web beacons, local storage) to operate the Service, remember your preferences, maintain your login session, and analyze usage. We may use third-party analytics tools (such as Google Analytics) that place their own cookies. You can control cookies through your browser settings; disabling cookies may affect some Service functionality.
Why We Collect Information and For How Long
We collect and process your information for the following purposes:
- To create and manage your account and deliver the Service;
- To process payments and manage your subscription;
- To send transactional communications (receipts, security alerts, service updates);
- To send promotional communications about MarkIt features and offers, where you have consented;
- To analyze usage and improve the Service;
- To comply with legal obligations and enforce our Terms of Use.
We retain account and billing information for as long as your account is active and for up to seven (7) years after closure to comply with tax and legal record-keeping requirements. Usage logs are retained for up to two (2) years. CRM Data you delete is removed from active systems within 30 days and from backups within 90 days. We may retain de-identified, aggregated data indefinitely.
Use and Disclosure of Information
MarkIt does not sell, rent, or lease your personal information to third parties.
We may share your information only as follows:
- Service providers. We share data with vendors who help us operate the Service, including Microsoft Azure (cloud hosting and storage), Stripe (payment processing), and email delivery providers. These vendors are contractually prohibited from using your data for any purpose other than providing services to MarkIt.
- Within your organization. Administrators on your account may view activity and data for members of their team.
- Legal requirements. We may disclose information as required by law, court order, or governmental authority, or to protect the rights, property, or safety of MarkIt, our users, or the public.
- Business transfers. If MarkIt is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We will notify you by email and post a notice on this page before your information is transferred and becomes subject to a different privacy policy.
- With your consent. We may share information with third parties when you have given us explicit consent to do so.
Non-Marketing Communications
Regardless of your marketing preferences, MarkIt may contact you for non-marketing purposes such as security notifications, service outages, billing issues, policy updates, or changes to the Service that may affect your use.
Children Under the Age of 13
The Service is not directed to children under the age of thirteen (13). We do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13, we will delete it promptly. Your Choices and Rights
Email opt-out. You may opt out of marketing emails at any time by clicking the unsubscribe link in any marketing email or by emailing [email protected]. Transactional emails (billing receipts, security alerts) are not subject to opt-out.
Access and correction. You may access and update your account information at any time through your account settings.
Data deletion. To request deletion of your account and associated personal data, contact us at [email protected]. We will fulfill deletion requests within 30 days subject to our legal retention obligations.
California residents (CCPA/CPRA). California residents have the right to: (1) know what personal information we collect, use, disclose, and sell; (2) request deletion of personal information; (3) opt out of the sale or sharing of personal information (MarkIt does not sell personal information); and (4) non-discrimination for exercising these rights. The Service may contain links to third-party websites. MarkIt is not responsible for the privacy practices of those sites and encourages you to review their privacy policies before providing any personal information.
International Users
MarkIt is operated in the United States. If you access the Service from outside the United States, your information will be transferred to and processed in the United States, where data protection laws may differ from those in your country. By using the Service, you consent to this transfer. MarkIt takes reasonable steps to ensure that international data transfers are conducted in accordance with applicable law, including, where required, the use of standard contractual clauses or other approved transfer mechanisms.
Security
MarkIt takes reasonable technical and organizational measures to protect your information against unauthorized access, disclosure, alteration, or destruction. These measures include encrypted data transmission (HTTPS/TLS), encrypted data storage, access controls limiting data access to authorized personnel, and regular security reviews.
No method of transmission over the internet or electronic storage is 100% secure. While we strive to protect your personal information, we cannot guarantee absolute security.
